These terms apply to your use of kohsamuielephants.com, and to any tour you book and pay for on this site. By using this site, or booking a tour through it, you accept these terms.
Who operates this site

This site compares and describes Koh Samui elephant sanctuaries and sells five tours at three sanctuaries: Samui Elephant Sanctuary, Samui Elephant Haven and Samui Elephant Home. Your booking contract is with Koh Tour Co., Ltd. (TAT license 42/00462). The tour operators and sanctuaries deliver the activities. Samui Elephant Kingdom and Elephant Jungle Sanctuary Samui are not sold on this site.
How booking actually works
You book on kohsamuielephants.com through KohTour's booking system. Choose your tour, date and guests, enter your booking details, and choose your payment option. Pay on tour is available in most cases. Groups of four or more pay a deposit. Pay the rest on the day in cash. Full online payment carries a 5% fee. Koh Tour Co., Ltd. handles your booking and sends your booking confirmation through the booking system. Your confirmation sets out your booked tour and its details. The tour operator or sanctuary delivers the activity.
Accuracy of information on this site
Prices, durations, inclusions, pickup areas, age bands and policies come from KohTour listing data. What you're charged, and the availability you're offered, when you actually complete a booking on this site is the live price and availability shown at checkout for that date. If something elsewhere on this site and the live checkout disagree, the live checkout governs your actual booking.
Cancellation policy
Every one of KohTour's five elephant tours carries the same cancellation terms, published identically on all five kohtour.com listings and applied the same way to a booking made on this site: canceling or moving your booking to another date is free up to 24 hours before the tour starts, with a full refund; cancellations made less than 24 hours before the start time are non-refundable, and no-shows are not refunded; if the operator has to cancel, for example for weather or safety, you can move to another date or take a full refund.
Commission disclosure
KohTour earns a booking commission on some of the tours described on this site, paid by the sanctuary when a booking made through this site completes. This doesn't change the price you pay. The welfare guide explains the activities and welfare policies of each park. Commission does not determine which parks meet the welfare standard described on this site.
On a tour, once booked
Once you've booked through this site, your booking contract is with Koh Tour Co., Ltd., and the tour operator or sanctuary runs the activity. Follow the instructions of your guide and the elephant park's staff throughout, including on photography, feeding and any contact with the elephants, and the elephant park's own published policy on riding, bathing and showing applies, not a universal rule this site sets.
Health, fitness and suitability
The three dedicated sanctuary tours (Samui Elephant Sanctuary, Samui Elephant Haven, Samui Elephant Home's two tours) don't state a minimum age or a health/fitness restriction on their own booking pages. The Jungle Tour by 4WD Truck with Elephant Feeding is not suitable for pregnant guests, wheelchair users, or guests with back problems or heart conditions. Tell KohTour before booking if any of these restrictions apply to your group. The 4WD tour involves truck travel and walking at the stops.
Insurance
Every tour covered on this site includes accident insurance. We still recommend separate travel insurance covering medical treatment and cancellation: the included accident cover is set by the operator, not by this site, and its coverage limits and terms aren't published on any of the five source pages we checked.
Liability
This site is an information and comparison service, and also the booking channel for the five tours sold here. We check what we publish against the sources named on each page and correct errors we're told about, but we are not the operator of any sanctuary: the tour itself is run by the tour operator or sanctuary you book, not by Koh Tour Co., Ltd. Nothing in these terms limits any liability that cannot be limited under Thai law, including for death or personal injury caused by negligence, or for fraud. Subject to that, we are not liable for loss, injury or damage arising from a tour itself, from information on this site that was accurate when checked but has since changed on the operator's own page, or from events beyond our control. Liability for the tour itself sits with the sanctuary operating it, under these terms.
Travel documents
Several of the tours covered here ask guests to bring a passport or photo ID for insurance purposes. Carry appropriate ID when you travel.

Privacy
How we handle your personal information on this site is set out in our Privacy Policy, which forms part of these terms.
Governing law
These terms are governed by the laws of Thailand, and the courts of Thailand have jurisdiction over any dispute arising from them. If any provision of these terms is found to be unenforceable, the remaining provisions continue in force.
